NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL AND MENTAL HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Still Power Counseling, LLC is committed to protecting the privacy and security of your protected health information (“PHI”). This notice describes how your health information may be used and disclosed and explains your rights regarding that information.
YOUR RIGHTS
You have the right to:
Get an electronic or paper copy of your health record.
You may request to inspect or obtain a copy of health information maintained about you. In certain limited circumstances, access may be restricted as permitted by law.
Ask us to correct your health record.
You may request that information you believe is incorrect or incomplete be amended. We may deny the request in certain circumstances but will explain the reason in writing when required.
Request confidential communications.
You may ask us to contact you in a particular way or at a particular location. Reasonable requests will be accommodated as required by law.
Ask us to limit what we use or disclose.
You may request restrictions on certain uses or disclosures of your health information. We are not required to agree to every request.
If you pay for a service completely out of pocket, you may request that information about that service not be disclosed to your health plan for payment or health-care operations. We will honor that request unless disclosure is required by law.
Receive an accounting of disclosures.
You may request a list of certain disclosures of your health information made during the six years before your request. Certain disclosures, including many made for treatment, payment, and health-care operations, are not included.
Receive a copy of this notice.
You may request a paper copy of this Notice of Privacy Practices at any time, even if you agreed to receive it electronically.
Choose someone to act for you.
If you have given someone legal authority to act on your behalf, such as a legal guardian or health-care power of attorney, that person may exercise your rights when their authority has been verified.
File a complaint.
You may file a complaint with Still Power Counseling, LLC if you believe your privacy rights have been violated.
You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights.
Still Power Counseling, LLC will not retaliate against you for filing a complaint.
YOUR CHOICES
For certain health information, you may tell us your preferences about what we disclose.
When applicable, you may tell us whether we may share relevant information with family members, friends, or others involved in your care or payment for your care.
If you are unable to communicate your preference, information may be disclosed when permitted by law and when determined to be in your best interest or necessary to reduce a serious and imminent threat to health or safety.
We will obtain written authorization when HIPAA or other applicable law requires authorization before using or disclosing your information.
HOW WE MAY USE AND DISCLOSE YOUR INFORMATION
Treatment
We may use and disclose your health information to provide, coordinate, or manage your treatment. For example, with appropriate authorization or when otherwise legally permitted, information may be exchanged with another health-care provider involved in your treatment.
Payment
We may use and disclose health information to bill and obtain payment for services. For example, information may be provided to your health insurer to determine eligibility, benefits, or payment for treatment.
Health-Care Operations
We may use and disclose information for activities necessary to operate the practice, such as quality improvement, compliance activities, administrative functions, auditing, and professional consultation when permitted.
Business Associates
We may use companies or individuals that perform services on behalf of Still Power Counseling, LLC and require access to PHI. When required, appropriate agreements are used to require these business associates to safeguard your information.
When Required or Permitted by Law
We may use or disclose health information when required or permitted by federal or state law. This may include certain situations involving public health and safety, suspected abuse or neglect, health oversight activities, judicial or administrative proceedings, law enforcement, workers' compensation, or preventing or reducing a serious threat to health or safety.
Additional protections may apply to certain types of health information under federal or state law.
MENTAL HEALTH AND PSYCHOTHERAPY INFORMATION
Mental health information may receive additional protection under applicable laws.
Psychotherapy notes, when maintained separately and meeting the legal definition of psychotherapy notes, generally receive additional protection under HIPAA. Authorization is generally required for their use or disclosure except in limited circumstances permitted by law.
SUBSTANCE USE DISORDER INFORMATION
Certain substance use disorder records may receive additional confidentiality protections under federal law, including 42 CFR Part 2, when those requirements apply.
Still Power Counseling, LLC will handle such records in accordance with applicable federal and state confidentiality requirements.
OUR RESPONSIBILITIES
Still Power Counseling, LLC is required by law to:
- Maintain the privacy and security of your protected health information.
- Provide you with this Notice of Privacy Practices.
- Follow the privacy practices described in the notice currently in effect.
- Notify affected individuals following a breach of unsecured PHI when notification is required by law.
We will not use or disclose your health information for purposes not described in this notice unless you provide written authorization or the use or disclosure is otherwise permitted or required by law.
If you provide authorization, you may revoke it in writing, subject to applicable legal limitations.
CHANGES TO THIS NOTICE
Still Power Counseling, LLC may change the terms of this notice. Changes may apply to health information already maintained by the practice as well as information received in the future.
The current Notice of Privacy Practices will be available upon request and through the practice's website as applicable.
